Example

C applied for help with food and utilities after using all their savings to cover travel costs following the death of a parent.

The council initially declined the application, stating C was not resident in their area. At first tier review, C provided proof of residency. However, despite submitting bank statements, the council concluded they could not verify C was facing a crisis situation.

C asked for an independent review. They explained that their mental health had deteriorated, they were unable to work, and had not yet applied for benefits. Although the statements showed few transactions, they confirmed minimal funds. We were satisfied that C had no money and were facing a crisis. We overturned the council’s decision, as we assessed that they had not fully considered the available information.

Recommendations

We instructed the council to make an award of £79.94 to cover food for a period of 14 days.

Feedback for the council

  • The council carried out a 28 day assessment but did include this in their decision letters.
  • The council incorrectly assessed the bank statements.

We have asked the council to provide us with confirmation that the award was made within one working day.
